§ 1. Subject of the contract
These terms govern the sale of Odoardo™ digital editions, including the e-books published in Odoardo Library™.
What is bought is one specific language edition. Buying one edition does not cover the other language versions of the same title.
Where an edition includes additional materials, we make them available together with the main file and on the same conditions.
§ 2. Purchase and delivery
If you request immediate access, we make the file available without undue delay once the payment is confirmed. Otherwise the day of release is set by the “Without the request” clause.
You download the edition in Odoardo ID™, in the section holding your editions. We also send a download link to the e-mail address assigned to the order. The link in the message works for the limited time and number of downloads stated in the message. In Odoardo ID™ you can download the edition without those limits for as long as you have an account.
We keep the file available for download for as long as Odoardo ID™ operates. We recommend saving the file after purchase. A downloaded file stays with you whatever happens to the account or to our service afterwards.
We make corrected versions of the same edition available free of charge in the same place.
§ 3. Right of withdrawal
When ordering a digital edition you may request immediate access to the file or receive it once the withdrawal period has run. Neither choice is a condition of buying.
You make the request for immediate access by ticking a separate checkbox when ordering (Article 38(1)(13) of the Polish Consumer Rights Act). The file is made available from the moment you can download it. The effect of the request on the right of withdrawal is set out in the “Statutory exclusions” clause of the Sales Terms.
If you do not make the request, we make the file available once 14 days have passed from the conclusion of the contract, from midnight Polish time. We state that date before payment and show it in Odoardo ID™, and on the day of release we send the link to the e-mail address assigned to the order.
§ 4. Licence
By buying an edition you acquire a non-exclusive licence, for an indefinite period and without territorial limits, for your own use: reading on your own devices, making one printout for yourself and making a backup copy.
The licence does not cover sharing the file with third parties, publishing it online, resale, lending, or use in commercial training.
Economic copyright in the content belongs to the author or to the Operator as publisher. Quoting extracts is permitted within the right of quotation, with the source given.
Distributing the file contrary to the licence entitles us to withdraw access and to pursue claims on general terms.
§ 6. Complaints
If the file is damaged, incomplete or not as described, we will bring it into conformity with the contract by making a correct version available. A technical problem with downloading does not release us from performing the contract. In that case we will make the file available another way.
