§ 1. Subject
These terms govern submitting a space to The Filmable Book by Odoardo™ — a curated yearbook.
Submission, nomination, distinction, the laureate title, publication and shipping of the laureate's certificate are free of charge. We charge no fee for taking part in the selection at any of its stages.
Participation is voluntary and creates no commercial obligations for either party. A submission is not an offer. Announcing the yearbook is neither a public promise nor a contest within the meaning of Articles 919–921 of the Polish Civil Code. The laureate title is an honorary distinction.
§ 2. Who may submit a space
Submissions are made in Odoardo ID™. One account may run several submissions in the same yearbook.
You declare that the space belongs to you or you manage it, or that you act with the consent of its owner or manager.
Any space with exceptional cinematic potential may be submitted, whatever the sector — from hotels and restaurants to museums, clinics, monuments and viewpoints.
A yearbook is a calendar year. A submission is assigned to the yearbook of the year in which it was sent. The yearbook closes on 31 December, and the laureates are announced by 31 March of the following year. Decisions in one yearbook do not carry over to the following ones.
The contract for taking part in the yearbook is concluded when you send the submission in Odoardo ID™.
§ 3. Submission requirements
A submission comprises the name of the space and one photograph in a square frame, prepared in the cropping tool available in the form.
We accept JPEG and PNG files of up to 15 MB.
The frame must show a real space. We reject photographs that are purely advertising material, a collage, a rendering, a graphic or an image generated by an artificial intelligence system.
Ordinary photographic editing is acceptable: cropping and correction of exposure, contrast and colour. Adding, removing or substituting elements of the space is not permitted, including with artificial intelligence tools.
You may complete a rejected submission with a new shot. The new photograph replaces the previous one, and the submission returns to selection.
Removing the photograph on a justified request of an entitled party does not withdraw the submission from the yearbook, and the submission keeps its status. You may send a replacement frame to which you hold the rights. We publish the replacement frame once the curator has approved it. A photograph removed on such a request is not accepted again.
§ 4. Your declarations
You declare that you hold the rights to the submitted photograph, or the consent of the rights holder, to the extent of the licence in the “Licence to the photograph” section.
You declare that the frame is a photograph of a real space and was neither generated nor materially altered by an artificial intelligence system.
Where people are visible in the frame, you declare that you hold those persons' consent to disseminate their likeness.
The photograph may not be encumbered with third-party rights excluding publication, including an exclusive licence granted to another party.
§ 5. Licence to the photograph
The licence is granted by you, the person who submitted the frame. In the proof of licence your details appear under the term “Licensor”. The licence is received by TITUTO Sp. z o.o., the publisher of the yearbook, called the Operator below, whose details appear in the proof of licence under the term “Licensee”.
You grant the Operator a non-exclusive, royalty-free licence to use the frame in the following fields of exploitation: reproduction by any technique, including printing and digital technique, placing on the market and lending copies on which the frame has been fixed, public display and screening, and making it publicly available in such a way that anyone may access it at a place and time of their choosing. The licence covers use of the frame in the yearbook, in the space's profile and in materials that report on the yearbook and promote it, in particular in press releases, on social media, on the Operator's websites and in its advertising.
The Operator may state, alongside the frame, the name of the space, its town and the year of the edition in which the frame was chosen. You declare that the photograph's author consents to its distribution without attribution, with the frame marked with the name of the space. At the author's request the Operator will name the author by first name and surname alongside the frame.
The licence also covers subsequent editions of the yearbook and the materials that announce and promote them.
The licence is not limited territorially.
The Operator may crop the photograph to any proportions, scale it, correct and grade its colour, remove technical defects, lay typography, marks and graphic elements over it, and place the frame in a layout, a montage and a video — by any means, including tools based on artificial intelligence. In doing so the Operator does not present the space untruthfully or hold it up to ridicule. The moral rights of the photograph's author are untouched.
The licence transfers no economic copyright. You may use the photograph and grant licences to others. An exclusive licence you grant to someone else does not limit the licence granted to the Operator until the licence granted to the Operator is terminated under the “Duration” provision.
The licence is granted for an indefinite term, subject to the provisions of law. Either party may terminate it with one year's notice, effective at the end of a calendar year. Withdrawing a submission terminates the licence on the day of withdrawal. Withdrawing a submission or ending the licence takes effect for the future only: from the day of withdrawal or termination the Operator makes no new copies containing the frame and places it in no new materials, and removes it from its own websites within 30 days. The Operator may distribute copies made earlier, including printed editions of the yearbook, until they run out, and need not remove materials published earlier, in particular on social media and in the press.
§ 6. Selection and statuses
A submission moves in turn through the statuses: submitted, nominated, distinguished and laureate. It may also be rejected.
Nomination is decided by the curator. The decision is discretionary, requires no justification and is not subject to appeal. This does not apply to a decision taken for a breach of these terms or of the law, which may be contested as set out in the “Rejection” clause.
A nominated space receives a distinction when its public profile reaches 500 unique visits, provided the profile holds an approved photograph. A distinction can be earned only within the year of the given yearbook, until 31 December Polish time. Visits after the yearbook closes do not earn a distinction.
The Chapter grants the laureate title among the distinguished spaces of the given yearbook. The Chapter is appointed by the Management Board of TITUTO Sp. z o.o. from members of the Operator's team and invited persons. The decision is discretionary, requires no justification, is not subject to appeal and does not depend on the number of profile visits. No visit threshold entitles a space to this title.
A distinction and the laureate title carry a place in the yearbook. A nominated submission that has not reached the distinction threshold has a public profile but does not enter the yearbook.
From the nomination on, a PDF certificate to print yourself is available with the submission's materials in Odoardo ID™. Its wording matches the current status, and after every change of status a new certificate replaces the previous one. A laureate additionally receives, free of charge, a certificate in a hand-made oak frame. The certificate is part of the honorary distinction that the laureate title is. We ask about the shipping details in a message to the e-mail address assigned to the account.
We add a note from the curator to every rejection. It does not close the way to another submission in the same yearbook. A rejection on discretionary grounds is not subject to appeal. You may contest a rejection or removal of a submission for a breach of these terms or of the law under the “Restrictions on our own initiative” clause of the General Terms.
No status is for sale. Buying Odoardo™ products has no bearing on the selection.
§ 7. Public profile
The space's public profile is created on nomination. It shows the name, the frame, the status and the yearbook and, for a nominated space, also its progress towards the distinction as a percentage. A submission awaiting the curator's decision and a rejected submission have no profile.
Visits are counted as unique. The counter is not published on the profile — you see it in Odoardo ID™.
You may use the press materials and status marks made available to you in Odoardo ID™, without changing their content and without suggesting a status higher than the one awarded.
§ 8. Withdrawing a submission
You may withdraw a submission in Odoardo ID™ at any time before a distinction is awarded.
Withdrawal ends publication of the submission and of the space's profile. The effects of withdrawal on the licence to the photograph are set out in the “Duration” provision of the “Licence to the photograph” section, and the keeping of the photograph in the Privacy policy.
A distinction means entry into the yearbook, which is a closed record of the edition. That is why we remove neither a distinguished submission nor a laureate's submission. We remove the photograph on a justified request of an entitled party, under the “Removal of the photograph on request” clause. After the licence to the photograph is terminated, the submission stays in the yearbook without the photograph, under the same clause.
Deleting the Odoardo ID™ account withdraws the submissions that have not entered the yearbook, with the effects set out in the “Effect” clause. A distinguished submission and a laureate's submission stay in the yearbook even after the account is deleted. We say so before the deletion of the account is confirmed. The basis for their continued publication is described in the Privacy policy.
We may remove a submission that breaches these terms, the law or third-party rights at any stage, including after it has entered the yearbook and after a status has been awarded. This also applies to a submission whose declarations have turned out to be untrue. A removal is decided by a person. We inform you of it with a statement of reasons, and you may contest the decision within six months under the “Restrictions on our own initiative” clause of the General Terms.
§ 9. No manipulation
Inflating the visit count with automated tools, proxy server networks or paid traffic bought solely for that purpose is prohibited.
If we find manipulation, we may correct the counter, revoke a status or exclude the submission from the yearbook.
Inviting real visitors to the profile is permitted and is a natural part of taking part in the yearbook.
